Preamble

These terms and conditions are subject to the application of French law. They are written in French. If they are translated into one or more languages, only the French text will prevail in case of dispute.

These terms and conditions of use are entered into between:

  • the manager of the web application, hereinafter referred to as "the Publisher",
  • any person wishing to access the application and its services, hereinafter referred to as "the User".

Article 1 - Principles

The purpose of these terms and conditions of use is to legally frame the use of the CHAT3D web application and its services.

The CHAT3D web application is a service provided by:

  • The simplified joint-stock company Chat3D

The terms and conditions of use must be accepted by every User, and their access to the application signifies acceptance of these conditions.

Article 2 - Evolution and Duration of the T&Cs

These terms and conditions of use are concluded for an indefinite period. The contract takes effect for the User from the start of using the service.

The CHAT3D web application reserves the right to modify the clauses of these terms and conditions of use at any time and without justification.

Article 3 - Access to the Application

Any User who has subscribed to one of the plans offered by the application can access it from anywhere with an internet connection. The costs borne by the User to access it (internet connection, computer equipment, etc.) are not the responsibility of the Publisher.

The application and its various services can be interrupted or suspended by the Publisher, notably for maintenance, without prior notice or justification.

The User of the application has access to the following services: Use of a Generative Artificial Intelligence Software. This software allows the generation of 3D models from images, textual descriptions, and collected data.

The application includes a paid member area reserved for registered users who have subscribed.
The application also includes a free member area for which it is sufficient to register without a subscription. These users can access it using their login credentials.

Article 4 - Responsibilities

The Publisher's liability cannot be engaged in case of failure, breakdown, difficulty, or interruption of operation, preventing access to the application or one of its functionalities.The connection equipment to the application used is under the full responsibility of the User, who must take all appropriate measures to protect the equipment and data, notably from viral attacks via the internet. The User is also solely responsible for the sites and data they consult.

The Publisher cannot be held responsible in case of legal proceedings against the User:

  • due to the use of the application or any service accessible via the internet;
  • due to the User's non-compliance with these terms and conditions.

The Publisher is not responsible for damages caused to the User, third parties, and/or the User's equipment due to their connection or use of the application, and the User waives any action against the Publisher as a result.

If the Publisher were to be the subject of an amicable or judicial procedure due to the use of the application by the User, it could turn against the User to obtain compensation for all damages, sums, convictions, and costs that may result from this procedure.

Article 5 - Intellectual Property

All technical documents, products, photographs, texts, logos, drawings, videos, etc., are subject to copyright and protected by the Intellectual Property Code. When shared with Users, they remain the exclusive property of CHAT3D.

Users commit to not making any use of these documents that could harm the Publisher's industrial or intellectual property rights and commit to not disclosing them to any third party without the express prior authorization of the Publisher.

Regarding the rights to 3D models generated on the application by the User, the User is the sole owner. Chat3D reserves the right to review the created models only to improve its software. It is up to the User to check if the generated object is subject to copyright.

Concerning the use of 2D images via the web application to generate 3D models, the Publisher does not guarantee ownership to the User. The User must therefore verify that their model is not under copyright before any personal or commercial use.

Article 6 - Hyperlinks

The User is strictly prohibited from setting up any hyperlink to all or part of the application without prior and written authorization from the Publisher, requested by mail at the following address: 35 Rue Pierre et Dominique Ponchardier Espace Fauriel, 42100, Saint-Étienne.

The Publisher is free to refuse this authorization without having to justify in any way its decision. If the Publisher grants its authorization, it is in all cases temporary and can be withdrawn at any time without justification.

In any case, any link must be removed upon the simple request of the Publisher.

Any information accessible via a link to other sites is not under the control of the Publisher, who declines all responsibility for their content.

Article 7 - Cookies

The web application may automatically collect standard information. All information collected indirectly will only be used to track the volume, type, and configuration of traffic using the application, to develop its design and layout, and for other administrative and planning purposes and generally to improve the service offered.

Article 8 - Applicable Law

These terms and conditions are subject to the application of French law. They are written in French. If they are translated into one or more languages, only the French text will prevail in case of dispute.

The parties agree to seek an amicable solution to any dispute that may arise from the performance of the services. If they do not reach an amicable solution, the parties will submit the dispute to the competent commercial court.

The Client is informed that they can in any case resort to conventional mediation, with existing sectoral mediation bodies or any alternative dispute resolution method (conciliation, for example) in case of dispute.Conditions générales d'utilisation
